Under the Sun/Oracle licensing (as with the Nvidia driver updates):
2. Permitted Uses.
Subject to the terms and conditions of this Agreement and restrictions and
exceptions set forth in the Software's documentation, Sun grants you a
non-exclusive, non-transferable, limited license without fees to
(a) reproduce and use internally the Software for the purposes of
developing or running an Open Solaris distribution.

Sun/Oracle licensing mentions you can use the binary driver to maintain an OS distro. If we are just providing an updated binary driver from the manufacturer for the same purposes - it should not be a problem (see: Nvidia driver updates) as long as all licensing and such is intact/included as provided. When in doubt, get legal counsel. We are not 'end users' nor changing the structure of distribution in this regard, but as an OS distro provider that already provides the binaries and was licensed by Sun to use the older version of the closed binary driver to maintain functionality with Broadcom hardware. Therein lies the rub.
