Sun/Oracle licensing mentions you can use the driver to maintain an OS distro. If we are just providing an updated binary driver from the manufacturer for the same purposes - it should not be a problem (see: Nvidia driver updates) as long as all licensing and such is intact/included as provided. When in doubt, get legal counsel. We are not 'end users' in this regard, but an OS distro provider that already provides and was licensing to use the older version of the closed driver. Therein lies the rub. Only update the binary drivers in the IPS package.
